Unfair competition by taxi companies that commit fraud with data of journeys and work and rest times must be detected by checking the BCT (taxi on-board computer). This increases the safety of taxi transport. When a self-employed person violates the driving and rest times, he has really gone too far.

Working and resting times for taxi transport.

For employees, break times by the legislator are as follows recorded30 minutes for more than 5,5 hours of work (possibly 2 × 15 minutes), 45 minutes for more than 10 hours of work (possibly 3 × 15 minutes) or by collective arrangement, deviations are possible up to: 15 minutes for more than 5,5 hours of work.

Rest time is 'not working at all'

Small self-employed persons (self-employed persons), on the other hand, only have to take 15 minutes for more than 5,5 hours of work. The daily rest time between shifts is at least 10 consecutive hours per 24 hours. The only deviation is shortened, 8 consecutive hours (maximum 2x in each period of 14 × 24 hours).

"The rules for self-employed people are becoming simple," explains Jantine Vochteloo of KNV Taxi. “You will soon have a minimum break and a minimum daily and weekly rest. It doesn't matter if someone works at night, or during the day, or on Sunday. Furthermore, the maximum driving time will be canceled. ”

If there are agreements between the employee and the employer, an unlimited number of night shifts may be worked. If there are no such agreements, the current rules apply. So a maximum of 52 night shifts per 16 weeks. Or 140 night shifts every 52 weeks. Or 38 night hours every two weeks. And a maximum of 39 Sundays per year.

“But again, if agreements are made between employer and employee, the same rules apply as with self-employed workers. So no limit, ”emphasizes Vochteloo.
