Funeral company Yarden has nevertheless achieved a victory at the court of appeal in Leeuwarden in the case concerning the in-kind policies. According to the judges, Yarden may nevertheless unilaterally limit the conditions for 390.000 insured parties in the case against the in-kind policies that had been brought by nineteen insured parties. The company had previously run into financial difficulties and was no longer able to meet its obligations under these insurance policies.

This statement is a boost for ailing Yarden. After a ruling by the Arnhem-Leeuwarden Court of Appeal on Tuesday in this policy in kind, the funeral cooperative may be looking for a buyer again. Yet the victory for Dela is not yet a fait accompli and points out that it is a judgment in summary proceedings and that the extensive substantive proceedings have not yet been completed.

Last year there was a big fuss when funeral insurer Yarden suddenly depreciated the rights of its parcel policyholders. At the time, a number of insured parties had instituted preliminary relief proceedings to reverse the policy change. Mobility during funeral transport such as the funeral car or the family trailers can suddenly turn out to be a lot more expensive than expected.

The funeral home of Yarden takes care of the funerals and cremations of its package policy holders. The case concerns the old package policies that cover a complete funeral or cremation. Yarden wanted to write down and freeze the policy rights by 2020.
