Entrepreneurs in freight and bus transport need a Euro permit to be able to carry out their work. One of the conditions for this is that the transporter and the transport manager of the transport or bus company are reliable. They can demonstrate this with a certificate of good conduct (VOG).

The Human Environment and Transport Inspectorate reports on their website that from 1 April this year, irrevocable sanctions imposed on European transport or bus companies at home and abroad will be registered in a national electronic register and included in the assessment of the reliability of carriers and transport managers.

Wim van Herk, senior inspector at the ILT: “In addition, they can lose that reliability status and thus their license if they commit too many (very) serious violations. This applies to violations in the Netherlands as well as in another European member state. European countries exchange this information about irrevocable violations via ERRU (European Register of Road Transport Undertakings). ”

In the Netherlands, penalty points are awarded depending on the type of violation. A penalty point maximum is set for transport and bus companies depending on their size. If a carrier exceeds the threshold value (penalty point maximum), he can lose his Community license (Euro license). A transport manager can also be declared unfit. With the points system, the ILT is better able to get notorious offenders off the road and to guarantee a balance in the market.

“We hope that transport companies will take action themselves on the basis of their registration to improve their business operations and thus compliance with the rules,” says Van Herk. Withdrawal of a license is a hefty sanction, but it is really intended to be able to deal with the notorious offenders in road and bus transport. If the reliability investigation shows that the company cannot restore confidence, it may lose the license ”.

If the threshold value is exceeded by a transport company, a reliability study will be carried out by ILT that focuses on a possible recovery of confidence. Entrepreneurs are notified when a violation is first registered in the ERRU (European Register of Road Transport Undertakings), but also when they are halfway through the threshold. In the meantime, transport companies can always view their number of points at the NIWO (National and International Road Transport Organization). Companies in bus transport can request their points from the ILT.

Van Herk: “Dutch transport and bus companies feel that their foreign colleagues in the Netherlands can break the rules without consequences. That is not the case, because the ILT can also fine foreign companies that commit violations in the Netherlands. But the registration system allows other EU member states to tackle companies based there if their trustworthiness is compromised. Each country can also choose its own method. Not every country will therefore have a points system like we do. But other countries can be stricter than the Netherlands and, for example, can withdraw the permit in the event of one violation. ”
