Soon after victims of the Limburg company Car Driver Deals united on social media to share suffering, we also saw an offer to victims to provide them with legal assistance. Reason for our editors to carry out further research. The first question that comes to mind is what do these services cost and what do victims get in return. We appointed a lawyer Oliver van Hardenbroek from The Hague the question of what is best for victims to do today.

to cooperate

The main tip is to remove personal belongings from the car and contact the car company that owns it. Advice is to cooperate with the return of the car and to report it to the legal expenses insurer if the injured party has it. Joining the office is absolutely not mandatory. The contractors can also submit their claim directly to CDD.

"Remove personal belongings from the car and contact the car company (if known) that owns it. cooperate with the return of the car. Report to legal expenses insurer. Joining our office is absolutely not mandatory. The contracting parties can also submit their claim directly to Submit CDD.'

The office offers the possibility to join and leave the legal part to experienced lawyers. If there is more need for personal advice about the situation with an explanation of the rights and obligations, they can assist. They also file a claim for reimbursement of monies paid in advance. In some cases, it is better not to do so now, but they advise to wait until the moment that Car Driver Deals (Atvangarde BV) does not meet its obligations.

bankruptcy filing

Van Hardenbroek is currently investigating whether there are assets that can be secured and whether there are parties that can be held responsible in addition to Car Driver Deals. An Autoweek journalist let slip that a bankruptcy petition had already been filed by a car company.

"An individual claim must be submitted, but no period of time has to be offered to remedy the situation. The mobility agreement with cdd has been terminated by operation of law and this creates legal obligations to undo."

In plain Dutch: then the contracting party is immediately entitled to a refund of what has been paid in advance and for which there is no longer a car available. Car Driver Deals customers are summoned by car suppliers to hand in their lease car. Because the Limburg company CDD is not affiliated with a trade association such as Keurmerk Private Lease or BOVAG, nor with a Disputes Committee, so that only the ordinary court is competent to handle disputes. Several car rental companies are currently trying to retrieve cars from lease drivers who are customers of CDD.
