KNV Taxi and Healthcare Transport, FNV Taxi and CNV Professionals have made agreements about the collective labor agreement Taxi and healthcare transport and the collective labor agreement SFT that will apply from 1 January 2021. If everything goes according to plan, the Mobility Social Fund will soon be actively looking over the shoulders of every taxi company with a digital online time clock. For this purpose, the Social Fund Mobility wants to bring an online portal in which all taxi companies that deal with wage drivers must register the services in advance. The target date is 1 July 2022, but it is already assumed that this date may not be feasible.

To minimize extra work at the taxi companies, software suppliers can link their packages with the portal or entrepreneurs can supply an Excel file. This does not only concern companies that work with the BCT in combination with data communication, but all taxi companies, without exception. The Social Fund Mobility can compare the times specified in the portal with the times registered in the BCT.

Service blocks

Under the new Collective Labor Agreement it has been agreed that an employee can one day work in a shift (known as the MaxFlex shift) or in shifts. Employees can therefore not work in shifts and in shifts in one day. Before 23:59 on the day prior to the work, the employer reports to the Social Fund Mobility (SFM) the working hours via the portal and whether an employee works in a shift or in shifts. It is therefore important that the start and end times of the service or service blocks are known in advance. For deviations, the BCT remains the guiding principle for the remuneration.

For contracts from 0 to 28 hours per week, a maximum of four shifts per day can be specified. All time within a service block is time to be paid. There can be no unpaid breaks in a service block and deviations in the BCT are leading for the remuneration. A service block lasts at least 1 hour and a driver between 2 service blocks is at least 15 minutes. For employment contracts longer than 28 hours per week, a maximum of 2 shifts per day can be specified. The duration of the service blocks together on 1 day is at least 7 hours. There is a minimum of 2 hours between the two service blocks. That is the time when the employee is not available to the employer.

Enforcement

The “Payment time” scheme will come into effect on 1 January 2022. The Mobility Social Fund will maintain the agreements made as of that date, even though the portal is not yet ready. The scheme will be evaluated after 1 year. The social partners will make further agreements regarding the consequences of non-compliance with the scheme. Wages themselves will increase by 1% from 2022 January 2,5. The trade unions have appointments created employers' organization KNV.
